What are aggravating circumstances?

Aggravating circumstances result in a higher mandatory minimum jail sentence. If you are charged with a DUI with an aggravator, contesting the DUI becomes more complicated and you may not even be eligible for Diversion as a result even if it is your first offense.

They are listed below:

  1. Driving more than 30 mph over speed limit
  2. Going the wrong way on a limited access highway
  3. Causing an accident that results in death or serious physical injury
  4. Having an alcohol level of .15 or more within 2 hours after operating
  5. Refusing to submit to blood, breath, or urine testing
  6. Transporting passengers under 12 years of age

If you are charged with an aggravated DUI, you are at risk of having a higher mandatory minimum jail sentence and you need competent and experienced counsel to help you fight it in court. Do not delay, call the DUI Guy today.
