Officer Cross Examination on Field Sobriety Tests: Throw the Manual at Them
Friends.
Below, and reproduced in full, is the article I wrote for the Kentucky Justice Association’s publication, ‘The Advocate.’
It was printed and distributed in September, 2014.

Enjoy.

Your boyfriend needs to hire an attorney who specializes in DUIs ASAP. He can help attack the machine, if he only had 2 drinks and blew such a high number.
Your BF was the one driving, so he is the one who got stuck with the offense.
I have heard this advice from a few criminal defense attorneys. A lot of people assume that you have to take a sobriety test. There are also some officers that just want to find an excuse to give you the ticket. That has happened many times to friends I know.
This advice was most helpful. My neighbor’s daughter was charged with a DUI a few days ago. This has never happened to her before and she is really scared. Having a criminal lawyer to help her navigate through everything would really help her.

LeeAn,

Wherever this occurred, he needs a lawyer.
Good luck.
